Introduction
Welcome to Onen (“we,” “us,” or “our”), a platform offering telemedicine services for the treatment of Alcohol Use Disorder (AUD). Our services connect customers (patients) with licensed psychiatrists, psychologists, and other healthcare professionals. AI DSS is not used for diagnosis, prevention, monitoring, treatment or alleviation of any disease or disorder. The complete treatment decision lies solely with the medical professionals. By using our services, you agree to comply with these Terms and Conditions. Please read this document carefully before proceeding.


Definitions
Customer (End User):

The individual availing our services for Alcohol Use Disorder treatment. This individual is competent to enter into a contract under the Indian Contract Act, 1872.
Healthcare Professional (HCP): Any licensed psychiatrist, psychologist, or other medical practitioner registered with the relevant Union or State regulatory body.
AI Clinical Decision Support System (DSS): A proprietary system designed to assist healthcare professionals by providing clinical insights. All clinical decisions, however, remain under the sole responsibility of the HCP.
Services: The telemedicine offerings, including consultations, therapeutic interventions, and digital tools provided by us, either directly or in collaboration with HCPs.
Third-Party: Any individual or entity other than Onen, HCPs, and Customers, who may interact with our platform or services.
Terms of Use: This agreement outlining the rights, responsibilities, and obligations of all parties involved in using our services.


Nature of Services and Limitations
Telemedicine Services for AUD:
Our platform enables customers to access medical and psychological consultations for the treatment of Alcohol Use Disorder via telecommunication tools. These services may include:Virtual consultations with psychiatrists and psychologists.Treatment planning and ongoing monitoring.Delivery of prescriptions and therapy recommendations.
Scope of AI DSS: The AI Clinical DSS serves as a supportive tool to aid HCPs in decision-making. It does not replace professional judgment or serve as a standalone diagnostic or treatment system.
Limitations of Telemedicine: Telemedicine does not allow for physical examinations or extensive diagnostic tests. Customers must understand the inherent risks and limitations of remote care.The services are not a substitute for emergency care or in-person consultations when necessary.
Territorial Limitations: Our services are designed to comply with Indian laws and medical guidelines. HCPs are licensed to practice in India, and customers accessing services from other territories must ensure their eligibility under local laws.


Customer Responsibilities
Accurate Information:
Customers must provide complete and truthful medical history, records, and information. Inaccurate or incomplete information may affect the quality of care and is the sole responsibility of the customer.
Compliance with Advice: Customers are expected to follow the treatment plans and advice provided by HCPs, including seeking in-person care when recommended.
Prohibited Use: Customers shall not:Use services for purposes other than the treatment of Alcohol Use Disorder.Engage in abusive, harassing, or illegal behavior toward HCPs or other users.Share misinformation or misrepresent their identity or condition.
Restricted Substances: Customers acknowledge that certain medications may require in-person consultation as per applicable regulations. HCPs shall not prescribe such medications via telemedicine services.


HCP Responsibilities
Professional Judgment:
HCPs retain full responsibility for diagnosing, treating, and advising customers, using the AI DSS as a supportive tool only.
Prescription and Follow-Up: Any prescriptions provided will comply with the Telemedicine Practice Guidelines and other applicable Indian regulations.
Confidentiality: HCPs are bound by ethical and legal obligations to maintain the confidentiality of customer information.


Privacy and Data Protection
Data Collection and Use:
Customer data, including medical history, consultation records, and sensitive personal information, will be collected, processed, and stored securely.
Disclosure of Information: Confidential information will not be shared with third parties unless: Required by law or regulatory authorities. Mandated by court orders. Necessary to provide services or improve treatment outcomes.
Customer Consent: By using the services, customers consent to the collection and processing of their data as outlined in our Privacy Policy.


Payment Terms
Charges:
Fees for consultations and other services will be communicated to the customer at the time of booking. Payment must be made in advance through our secure payment gateway.
Refund Policy: Payments are non-refundable except in cases of service non-delivery.
Third-Party Payment Gateways: We use trusted third-party payment gateways. We do not store payment details such as credit card or net banking information.


Prohibited Conduct
Customers shall not: Use services in violation of applicable laws.Transmit harmful, obscene, or offensive material via our communication tools.Attempt unauthorized access to our systems or misuse the services for fraudulent purposes.


Disclaimer of Liability
Service Interruptions:
We are not responsible for delays or interruptions caused by factors beyond our control, including technical failures, power outages, or Acts of God.
No Guarantee of Outcome: While we strive to provide high-quality care, we do not guarantee specific treatment outcomes.
Third-Party Services: We are not liable for the quality or authenticity of products or services offered by third-party pharmacies or labs accessed through our platform.


Termination of Services
Customer Violations:
We reserve the right to suspend or terminate services without notice in cases of:
Non-compliance with these Terms.
Harassment, abuse, or illegal activities.
Misuse of the platform.
Discretionary Termination: Services may also be terminated at our sole discretion for reasons not listed above.


Dispute Resolution
Mediation and Arbitration
Disputes shall first be submitted to mediation in Hyderabad. If unresolved, arbitration proceedings will be conducted under the Arbitration and Conciliation Act, 1996, with the sole arbitrator appointed by us. The decision of the arbitrator shall be final and binding.
Jurisdiction
All disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.

Amendments
We reserve the right to amend or modify these Terms at any time. Changes will be communicated to customers, and continued use of the services constitutes acceptance of the revised Terms.

Force Majeure
We shall not be held liable for delays or non-performance arising from events beyond our reasonable control, including but not limited to natural disasters, governmental actions, or technical failures.

Entire Agreement
These Terms constitute the entire agreement between the parties concerning the use of services and supersede any prior agreements.
